Melonteelic offers an online platform where users can design and sell their own T-shirts and other merchandise.

We have a strict policy against allowing users to create or sell products that infringe on the intellectual property rights of others, including but not limited to copyrights, trademarks, and related rights.

If you believe that a user on Goldteelic has violated your intellectual property rights, please follow the procedure outlined below.

A. Reporting Intellectual Property Infringement:

Melonteelic will take prompt action in good faith to block or remove any content (“Content”) that appears to infringe on the intellectual property rights of third parties upon receiving a valid notice of infringement.

Accounts of repeat offenders will be terminated. If you believe your intellectual property rights, such as copyright, are being infringed upon by Content on the Melonteelic platform, please submit an infringement notice to the Designated Agent containing the following information:

  1. Identification of the Infringed Work: Provide details about the copyrighted work or other intellectual property, including registration numbers if applicable.
  2. Identification of the Infringing Content: Include a description of how the content is infringing on your intellectual property and the location of the infringing material on the Melonteelic platform with sufficient detail for verification.
  3. Contact Information: Provide your full name, mailing address, phone number, and email address.
  4. Statement under Penalty of Perjury: Confirm that the use of the copyrighted work or intellectual property is not authorized by the rights holder, its agents, or the law, and that the information provided is accurate.
  5. Signature: Provide an electronic or physical signature from the authorized person acting on behalf of the rights holder.

B. Upon Receiving a Valid Infringement Notice:

Melonteelic will remove or disable access to the content that is allegedly infringing.

The user whose content has been removed or disabled will be notified.

Repeat offenders will have the infringing content permanently removed, and their account access will be terminated.

C. Procedure for Submitting a Counter-Notice:

If a user whose content was removed or disabled believes that the content was not infringing or that they have the right to use it, they must submit a counter-notice with the following details to the Designated Agent:

  1. Identification of the Removed or Disabled Content: Describe the content’s location on the Goldteelic platform before it was removed.
  2. Statement under Penalty of Perjury: Declare that the removal or blocking of the content was due to an error or misidentification.
  3. Contact Information: Provide your full name, mailing address, phone number, and email address.
  4. Jurisdiction Consent: Agree to the jurisdiction of the Federal Court for the judicial district where your address is located, or if outside the USA, where Goldteelic is located.
  5. Signature: Include your electronic or physical signature.

If a counter-notice is received, Goldteelic may forward a copy to the original complainant, notifying them that the removed content may be reinstated or restored within 10 to 14 business days, unless the rights owner takes legal action.

Please note that under Section 512(f) of the DMCA, anyone who knowingly misrepresents that content or activity is infringing may be held liable for damages, including attorney’s fees.
